AIRWISE TESTING LLC – DIGITAL DISCLAIMER AND LIMITATION OF LIABILITY

1. Scope and Limitations of Testing

The air quality testing, analyses, and findings (“Testing Results”) provided in this report:

  • Are strictly limited to the conditions observed during the specific testing period indicated.

  • Do not represent or guarantee air quality conditions at any time before or after the testing period unless explicitly stated.

  • Represent a snapshot of conditions at specific testing locations only.

  • Do not guarantee compliance with any air quality standards or regulations.

  • Do not include long‑term monitoring unless explicitly specified by AirWise Testing, LLC (“AirWise”) under a separate agreement.

2. Nature of Services and Recommendations

2.1. Services Provided

All services provided by AirWise, including testing, analyses, and recommendations:

  • Are advisory in nature.

  • Are based exclusively on data collected during the specified testing period.

  • Are not intended or designed as legal compliance tools.

  • Do not constitute medical, legal, or regulatory advice.

2.2. Service Limitations

For this report, AirWise does not:

  • Monitor ongoing or continuous indoor air quality unless under contract for long-term monitoring.

  • Guarantee the resolution of air quality issues.

  • Certify building safety or compliance with regulations.

3. Use of Artificial Intelligence (AI)

3.1. AI‑Assisted Interpretation

AirWise uses artificial intelligence (AI) to assist in interpreting indoor air quality data, identifying risk patterns, and generating recommendations. AI may be used to:

  • Analyze trends and anomalies in sensor data.

  • Provide potential explanations for indoor environmental risks.

  • Suggest basic corrective actions or follow-ups.

3.2. AI Limitations

  • AI-generated content is reviewed by qualified professionals, but may contain limitations such as oversimplifications or incorrect classifications.

  • Recommendations are informational only and are not a substitute for professional judgment, regulatory compliance measures, or emergency response protocols.

4. Disclaimer of Warranties

AirWise disclaims all express, implied, or statutory warranties, including but not limited to:

  • Merchantability.

  • Fitness for a particular purpose.

  • Accuracy, reliability, or completeness of the Testing Results or recommendations.

  • Effectiveness of any remedial measures.

  • Legal or regulatory compliance at the monitoring site.

5. Limitation of Liability

To the fullest extent allowed by Massachusetts law, AirWise, its employees, and agents shall not be liable for:

  • Any direct, indirect, incidental, special, or consequential damages.

  • Lost profits or business interruptions.

  • Claims arising from use of or reliance on the Testing Results or AI-generated interpretations.

  • Costs or losses associated with implementing recommended measures.

6. Client Responsibility and Risk

By accessing or using this report, the client acknowledges and agrees that:

  • Indoor air quality data reflects conditions at a moment in time and is subject to change.

  • It is solely the client’s responsibility to determine how to act upon the information provided.

  • Indoor environmental conditions may require additional monitoring or professional evaluation.

7. Sensor Accuracy and Environmental Conditions

Sensor-based data may be influenced by:

  • Environmental variables such as temperature and humidity.

  • Calibration drift over time.

  • Interference from household activities, occupants, or materials.

Raw sensor data should not be used for regulatory or legal purposes without independent verification.

8. Data Security and Privacy

8.1. Data Handling

  • AirWise collects and stores air quality data electronically.

  • Reasonable precautions are taken to secure this data, but no system is infallible.

8.2. Data Use

  • Aggregated, anonymized data may be used to improve services.

  • Client-specific data will not be shared without consent unless required by law.

9. Governing Law

This disclaimer shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts.
